Vaccine Injury Pros Contributes to Keeping SIRVA a Covered Vaccine Injury

As mentioned last month, for the last year, administrators with the U.S. Department of Health and Human Services have been proposing amendments to the Vaccine Injury Table (Table) for claims made to the National Vaccine Injury Compensation Program (VICP).  Vaccine Injury Pros was part of the effort to oppose that action, which would have been contrary to the language and intent of the law that created the VICP.

When the Department filed a proposed rule change in 2020, lawyers who regularly represent injured persons in the VICP worked together to convince the decision makers to rescind that action.  The result was that no changes were made to remove from coverage Shoulder Injuries Resulting from Vaccine Administration (SIRVA) and vasovagal syncope (loss of consciousness or fainting).  For his part, Richard Moeller submitted a comment setting forth a detailed explanation of how and why the proposed changes were not only unauthorized by law, but also bad policy.  His submission can be found at https://www.regulations.gov/comment/HRSA-2020-0002-0634
